The vision of this office can be formulated as: "The control, ownership,
and use of land which support the empowerment of the people's economy,
strengthen the unity and integrity and self-resilience of the nation as
well as enhance competitive- ness in the globalization era, supported by
regulations on the law and general planning of regional zoning, and
able to realize an optimal land use for the people's prosperity based on
social justice".
Accordingly, the mission is to manage and develop the agrarian administration,
covering regulations on land authorization and possession, land-use, issuing
land rights, measure and register land property based on the agrarian principle
law and law regulations concerning agrarian matters.
The objective is the creation of an orderly agrarian condition regarding
agrarian administration, land law, land use as well as land and the environment
maintenance. The targets are:
A harmonious zoning and agrarian system for social, economic as well
as defense and security interest; a more established way of implementation
and control on the use of land which is able to guarantee the realization
of social functioning of land right and prevent centralization of land
control; Accelerated regional expansion, eradicate poverty and prevent
the gap of land control; an integrated agrarian management system which
is harmonious, effective and efficient; a climate for development in all
sectors use land; an information system with updated and transparent data,
which supports the agrarian and regional zoning; a qualified and high capability
board and apparatus on land management, with professional executives; a
more stable agrarian service system, with principles which are simple,
safe, sophisticated, accessible and transparent; a more complete agrarian
implementation regulations to give a conducive climate for development,
especially for the protection of the grass-root level an enhanced awareness
and participation of the people as well as the business world in the agrarian
management; equal and correct understanding and perception of the people
towards agrarian law.
Improvement of Services
Efforts to enhance and improve public services cover: (a) simplify
and standardize the procedures and the condition transparently by eliminating
unnecessary procedures: (b) prepare list of fished changes for the public,
to prevent the illicit levies; (c) each office determines how much time
they would need, so that anybody who have completed their forms would maximally
need only three visits to get the documents. The three visits would only
be for submitting the forms, pay the fee and collect the documents; (d)
give service by window system, so that customers would only meet the officer
at the window, not the one who processes the documents; (e) provide opportunity
for public complaints through PO Box 4000 and facsimile address to the
Minister, as well as boxes for letters of complains in each office, and
other strategic sports.
To accelerate services to the people, especially regarding land rights,
preliminary steps have been made to decentralize the procedure of taking
decision, and give greater authority to decide on land right to
the regional officials, especially the Head
of Districts/Municipality Agrarian Office.
Equality and Justice in Land
Control
In line with the mandate given to the Government of the Development
Reform Cabinet by the People's Consultative Assembly of the Republic of
Indonesia Decree No. XVI/MPR/1998 on Economy Politics in an economic democracy,
Article 7 regulates the following policies and measures: (a) apply land
management through land redistribution and provide compensation from available
government budget and with the people's resources to improve the farmers'
welfare; (b) carry out management for land control and land use through
consolidation of urban and farm land, using available government budget
and the people's resources. Land consolidation is the agrarian policy to
restructure land-title and land use through active participation of the
people who are members of cooperatives and institutions from the people,
by the people and for people, as an effort to encourage the people in development
(to develop without taking land away from owners); (c) emphasize and strengthen
the government intention to step up the implementation of land-title by
Presidential Instruction and control the ownership of farm-land by Instruction
of the Minister of Agrarian Affairs/Head of the National Agrarian Board
as the follow up of the Presidential Instruction; (d) limit the maximum
extent of farm and non-farm land ownership for individuals and establishments;
(e) control the less efficient use of land by not allowing absentee ownership
of land; (f) control the implementation of crop sharing, as well as form
land pawning and rent.
Use of Idle Land
Each of the rights-holder is obliged to use his/her land in line with
the intensity and use of land according to the principle of Preservation/
Optimal use/Harmony, and Balance (LOSS), to maximize the use of land to
realize a just and prosperous society. At the same time this policy would
support programs at times of food crisis and unemployment, especially in
the big cities.
Right holder of lands which are not functioning in accordance with the
purpose of land use and in view of the issuance of land right is for land
with social functions, should switch to food crop planting, for the time
being. In such cases, the rights-holders may consider carrying on by themselves
or join with other parties. If they are not able to use the lands, they
are entitled to allow the District administration (Pernda Dati II) to manage
their property as idle land. Otherwise, these rights owners could face
changes as sanctioned by Government Regulation No. 36 of 1997 regarding
neglected lands.
As to the practice of cultivating land by someone other than the rights
holder the local administration (PEMDA) takes legal steps by issuing a
guarantee that the rights holder would get back his property as soon as
he is ready to assume his original plan.
Issuance of Land Rights
The availability of land for housing (residence) is purpose essential
for each citizen.. To guarantee legal certainty of land ownership for housing
purpose the Indonesian Citizens has the opportunity for ownership right,
when a citizen purchases a house from a real estate enterprises the Building
Usage Right, that comes with the purchase, would be upgraded to ownership
right.
Land Rights Fee
According to Agrarian Principle Law (LJUPA), each holder of a land
right is entitled to pay a fee which is a revenue to the State Budget.
This revenue is allocated for the management of the over-sized land sites,
as regulated by the Agrarian principle Law. Accordingly the amount of fee
is regulated considering to the type of land right, its length of time,
the size of land, and tariff. Land owners of the weak economical group
are exempted from land right fees.
Managing Agrarian Problems
The Minister of State for Agrarian Affairs/ Chairman of the National
Agrarian Board Regulation Number I of 1999 on the procedures in handling
land disputes is the basis for legal settlements in cases of land disputes.
This policy is an anticipative and responsive effort to the latest phenomena
in the society, which requires efficient and free of charge services on
ways to settle land disputes. In this regard the national and local offices
have formed working teams of which the working procedures cover formal
juridical matters and material juridical research. Efforts are also made
for a possible role of the national Agrarian Board to act as mediator,
in accordance with current regulations of the statutory law, based on the
principle of justice.
Enhancement of Public Participation
To register land property throughout Indonesia, one needs to have his
piece of land measured and a cadastral map made to obtain a framework for
basic mapping, a basic map, a land site map and land registration map.
To improve and accelerate services in land registration in particular and
accelerate the process of measuring and mapping in general, the people
at large are given the opportunity to participate by becoming licensed
surveyors in the capacity of national Agrarian Board land measurer. One
could also join the Agrarian Order Aware group to assist programs of the
community.
Supporting the Social Safety
Net
To support the Social Safety Net, land rights are given to the economically
weak. With legal certainty, the farmers feel more secure in working their
land. This conditions could increase productivity which in turn would improve
the people's welfare.
Activities to support the Social Safety Net are through:
1. Land management Program;
2. Settlement and Transmigration Environment Program.
Agrarian Laws in the Reform Era
Following are laws issued to support reform efforts:
a. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Instructions Number: 3 of 1998 on Enhancement of Public Service Efficiency and
Quality in the Agrarian field.
b. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Instruction Number 4 of 1998 on the Acceleration of Registration for Land Ownership
Rights for Residence purposes.
c. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Instruction Number 5 of 1998 on Issuance of Location Permits in the Program of
Land-title in Large Scale.
d. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Instruction Number I of 1999 on the Settlement of postponed Handling of People's
Application for Land Rights.
e. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Regulation Number 2 of 1998 on Licensed Surveyors.
f. Minister of State for Agrarian Affairs/Chairman of the
National Agrarian Board Decision Number 6 of 1998 on Issuance of Land Ownership Rights for Residential.
g. Minister of State for Agrarian Affairs/Chairman of the National
Agrarian Board Number 3 of 1998 on the Use of Idle Land for Crops Plantation.
h. Instruction of the Minister of State for Agrarian Affairs/Chairman
of the National Agrarian Board Number 4 of 1998 on the Guidelines to of Determining Revenue in Giving
Rights over State land.
i. Instruction of the Minister of State.for Agrarian Affairs/Chairman
of the National Agrarian Board Number 2 of 1999 on Location Permits.
j. Instruction of the Minister of State for Agrarian Affairs/Chairman
of the National Agrarian Board Number: 3 of 1999 on Delegation of Authority to Issue and Limit
the Rights of Land.
In the program to accelerate services for the public in, the Agrarian
Office has established 304 service windows, and put signs about how much
time and money one would need to have his certificate of rights ready.
In 1998/1999, 1,247,562 certificates were issued by the Agrarian Office.
So far, 37,710 ha of idle land has been planted with food crops..
With regard to Minister of State for Agrarian Affairs/ Chairman of the
National Agrarian Board Regulation Number 6 of 1998 on land ownership rights
for residential purposes, the Rights of Use for 68,940 plots of land spread
out in 11 provinces have been upgraded to ownership Rights. A number 91
licensed surveyors and 96 assistant surveyors have been installed.
Activities in the agrarian sector to support the Social Safety Net consist
of:
• Issuing land rights for 119,498 land plats of the of Agrarian
PRONA Project.
• Issuing land rights to 15, 889 plots/families by way of land
redistribution to development project sector of land-title authority.
• Issuing land rights to 619,296 plats of land by way of adjudication
on agrarian administration project sector.
• Inventarization and control of 417,000 ha idle land. .
• Issuing land rights to 78, 325 plots of land through agrarian
projects in transmigration areas.
THE
YOUNGER GENERATION AND SPORTS
The relationship between the development of the younger generation
and sports is consider very strong and can not be separated. Therefore,
the vision and mission of the office that was more developed in the reformation
era, also united and does not be separated.
The vision of the Office of tt]e Minister of State for Youth Affairs
and Sports Office is to develop progressive independently, with high moral
and competitive in the globalization era.
That vision is clarified in the mission to empower the younger generation
and sports, by way of realizing harmonious balance between quality and
quantity of younger generation and sports development, as a human resources
potential and the environment so that become effective resources in entire
national development spectrum
(Ideology, Politics, Social, Culture, Economy, Security and Defense,
Legal, Science and Technology, and Environment).
Younger generation empowerment is to endeavor the establishment of Indonesia's
younger generation with high moral standards, religions, devoted to the
One and Only God, honest, polite, tolerant and civilized in accordance
with Pancasila, democratic, independent, entrepreneurial, discipline, struggle,
nationalism awareness, study hard, competitive and succeed, professional,
own a work ethic, creative, innovative and productive, and also intellectual
who has a certain quality and competitive.
The goal and objective of younger generation and sports empowerment
have been determined to spell out the vision and mission. The goal to empower
the younger generation and sports is to synchronize and integrate the way
of thinking, ideas, initiatives and efforts that will be realized by the
government and the people, into
the programs to empower the younger generation and sports as one of
the priorities of human resources development and the succeeding generation
in of the 21 century.
A total information aspiration in various aspects according to the demand
of younger generation, the youth and university students are disseminated
through dialogue forums, on the national and regional level.
Also, the management and participative development planning pattern
that is aspirative, which is democratic, and appreciative, has involved
as many as possible elements of younger generation, the youths, students,
and the higher learning community, professionals, and NGO through the 1999
Younger Generation and Sports National Coordination Meeting (Rakornas PORA).
Efforts were also made to change the younger generation development
orientation was originally more emphasized on the development and education
of younger generation which is reflected by ideology and politics, to empowerment
of the youth which is reflected more by economics', social life, culture,
law, science and technology, and the environment.
The Government also adopted the "back to basic" principle and sports
as "national and character building" based on sport standard in sport development
policy.
Among the most prominent achievements are the motivation and consistency
of local governments in most of the provinces in Indonesia to stipple out
the efforts to the empowerment of the younger generation and sports in
the region, by forming and effectuating the Office of the Minister of State
for Youth Affairs and Sports of the First and Second Regional level.
The Office have also succeeded to gather and organize the aspirations,
ideas and initiatives of the region
for efforts to the empowerment of the younger generation
and sports that based on a reformation spirit and regional matters, obtained
from the youth and sports safaris and national coordination meeting on
youth and sports.
The Office has also conducted youth trainings that no longer indoctrinates
only matters for government interest, but trainings which are more democratic,
transparent, communicative, aspirative and partisipative according to the
need and understanding of reformation.
It has also developed positive climate for of the younger generation
aspiration, especially the youth and university student, through dialogue
forums, which are democratic, communicative, and transparent.
Also of equal importance is the reality that the freedom to express
ideas and different responsible ideas has been accepted by the younger
generation circle, youth and university students, as the vehicle of democratization
in the reformation era, including freedom to assemble or not to join in
one specific youth organization, university students organization or political
organization.
